Risk — News outlets and other third parties may now be liable for Facebook comments made on their page

Dylan Voller, a former youth detainee, has had a landmark win in the first round of his case against Fairfax Media, Nationwide News and Sky News in the New South Wales Supreme Court (the Voller case).1 Mr Voller claimed the media companies should be held liable for alleged defamatory comments made in reply to news stories about him posted on the media companies’ Facebook pages between June 2016 and June 2017. Mr Voller claimed the comments had caused significant damage to his mental health and his reputation.
